The problem: All of the tapes are property of PodTech, the videoblogger's former employer, so all he can release are the still images, like this one of Hunter seated with Edwards.

The accidentally historical shot is among those circulating on the AP wire, he told Valleywag this morning: "I never in a thousand years thought I'd be witnessing a scandal. But I don't really care about the sex part of it."

Except he does. Scoble says he and others on the blogger plane, like Andrew Baron of Rocketboom, are glad the affair is out in the open now — and not just so they can flog their photos: "We're all disappointed that he took such a risk with the presidency in the balance." Despite his past support of Edwards, said Scoble, "I'm really happy he wasn't nominated. If he was the nominee right now, it'd have handed the election to McCain." We're not normally fans of tech bloggers turning into political pundits, but Scoble's analysis is spot-on.

<![CDATA[Did the New York Times Joker-ize Digg CEO Jay Adelson?]]> Saul Hansell quoted Digg CEO Jay Adelson defending the Associated Press (of which Hansell's publication the Times is a member). TechCrunch's Michael Arrington freaked out, natch. Adelson then attempted to further explain his complicated position, trying to be diplomatic. Yawn. As we've said before, and will say again, exercise your fair use rights under the law and shut up, because giving the AP attention just feeds its argument and therefore reinforces its position. Moving on:

What struck me about Hansell's piece was the use of a file photo that features a wildly grinning and unbelievably baby-faced Adelson — with professionally trimmed hair, no less! Looks a little too much like a certain viral movie marketing campaign to be a coincidence. Is the gray lady secretly synergizing with News Corp. on the latest Dark Knight release and subtly Joker-izing Adelson?

<![CDATA[Michael Arrington drops the banhammer on the Associated Press]]> A couple of bloggers have gotten their panties in a bunch because the Associated Press, a coop that offers original reporting to its 1,500 member newspapers and syndicates to other outlets, is asking that they go a little easier on the copy-paste. TechCrunch's Michael Arrington is having none of it!

[T]hey are trying to claw their way to a set of property rights that don’t exist today and that they are not legally entitled to. And like the RIAA and MPAA, this is done to protect a dying business model — paid content.

Funny, TechCrunch syndicates content to the Washington Post, so we're to assume that Arrington's doing it gratis. I'd just hate to think that august news organization is paying for his content. While the AP's legal effort is hamhanded, by ignoring the coop's cease-and-desist letters and forcing the issue of copyright law's "fair use" exemptions, bloggers might have an opportunity to get courts to clarify murky fair-use guidelines. But why do that when it's so much more fun to troll an organization doing scads of actual journalism around the world?

Although it kind of appears to be. It you blow up the picture, you can see it is Cheney's hand gripping the handle of a fishing rod. So much for putting "who, what, when and where" in the first line, eh AP? I like that they use a TinyURL link at the bottom too. Thank you, in-the-know record executives! Ian Rogers, the general manager of Yahoo Music, publicly said much the same thing back in October.

This news only dwindles even further the value of Yahoo's subscription music service, which its reportedly been trying to offload for around $90 million. Why won't that happen? The most likely buyer, Napster, doesn't have even that much cash lying around. RealNetworks could buy it, but they're more focused on their booming mobile business right now. Or at least they should be.

<![CDATA[AP commits first mainstream media screwup at Web 2.0]]> An informant reports that high-energy Microsoft CEO Steve Ballmer's early morning razzle-dazzle outpaced one reporter:

They [the Associated Press] ran the story on Ballmer this morning, got the facts all turned around. Did you hear his talk? He used an the analogy of MS Search being a 3 yo basically playing basketball with the big kids, the 12 year olds. Great analogy, really worked for him and got big laughs. Rachel Konrad printed it the other way around and ran a photo that made Ballmer look like a cackling demon. OUCH. MS people were fried and demanded a "reprint". Worst part was she demanded video to prove her wrong.
Also missed by the AP's now-corrected report: Ballmer's Starbucks beverage was a grande iced tea, the last third of which seemed to have gone warm in his sizeable right hand. He uses the long green Starbucks straw, not the short black one. Details, people, details! (AP Photo/Paul Sakuma)]]>
